Mediation and commission

3% is not
a law.

If someone told you the minimum commission is fixed by law, they told you something false. Here is what the rules actually say.

What the law says

Estate mediation is governed by Law 39 of 1989. On the amount of the commission, Article 6 says only one thing: it is set by the parties.

There is no minimum tariff. There has never been a binding tariff for this sector, and in 2004 the Italian Competition Authority expressly confirmed that tariffs do not apply. The amount is freely negotiated.

So where does the 3% come from?

From the collections of commercial customs kept by Chambers of Commerce. Each chamber records customary percentages for its province — often around 3% from each of the two parties, plus VAT.

They are customs, not statutes. They fill a gap: they apply only when the parties have not agreed anything in writing. If an amount is agreed, that amount prevails.

Here is the trap

Silence does not work in your favour. A mandate that does not state the commission can be referred back to local customs — that is, in many provinces, exactly that 3% from both parties.

Never sign a mandate with a blank percentage, "to be agreed", or deferred to an annex you have not read.

Courts, for that matter, have gone well below that threshold when the work done did not justify it: in a case decided by the Venice Tribunal, 0.5% of the property value was held reasonable because the agent had neither conducted the negotiation nor collected the offer.

When the commission is due

Not on signing the mandate, and not when a potential buyer appears. The right accrues on conclusion of the deal: when the parties are bound, typically on an accepted offer.

Until then, any figure you are shown is an estimate, not a debt. If a quote does not say so, ask for it in writing.

Fixed prices do not change with property value: they are the same on a €150,000 home and an €800,000 one. They are shown before you order and do not rise afterwards.

On the sell-privately path EasyCasa operates as a portal: it does not perform real-estate mediation and does not earn a commission on the sale price. Optional services stay flat-fee, shown before you order.

Five things to check before you sign

This applies to any mandate, not only ours.

  1. Is the percentage, or the amount, written down?If it is missing, or deferred "to custom", you are signing an amount you do not know.
  2. Who pays: you, the other party, or both?In Italy it is customary for the agency to collect from both. It must be explicit.
  3. When does the right accrue?It must say "on conclusion of the deal". Be wary of wording that brings that moment forward.
  4. Is there exclusivity, and for how long?Check duration, automatic renewal and penalties if you withdraw.
  5. What if you sell on your own?Some mandates still provide for a fee. That can be lawful, but you need to know before.

Why we tell you all this

Because we have nothing to lose by it. We do not earn a percentage of the sale price, so we have no reason to let you believe 3% is mandatory.

If after reading this page you choose a traditional agency and negotiate a lower percentage, that is fine with us. The point was that you could negotiate it.
